ARTICLE 2 – SUBJECT
This contract, within the framework of the provisions of the Law No. 6502 on Consumer Protection and the Distance Sales Contracts Regulation, regulates the rights and obligations of the parties regarding the sale and delivery of products ordered electronically by the BUYER from the SELLER's website www.noktaoptik.com.
ARTICLE 3 – PRODUCTS SUBJECT TO THE CONTRACT AND DELIVERY
- The BUYER acknowledges that they have been informed about the basic characteristics, sales price, payment method, and delivery period of the products purchased through the pre-information form.
- Products will be shipped within 3 business days after the order is confirmed and delivered to the BUYER's address.
- Delivery time may vary depending on the distance of the shipping address and logistical conditions, not exceeding 30 days.
- The product will be sent to the invoice and delivery address specified by the BUYER.
- The SELLER cannot be held responsible if the BUYER is not present at the address at the time of delivery or if the product is not received by the person specified at the address.
ARTICLE 4 – RIGHT OF WITHDRAWAL
- The BUYER may exercise their right of withdrawal within 14 days from the delivery date without stating any reason.
- For the right of withdrawal to be valid, the product must be unused, its packaging undamaged, and in a resalable condition.
- The right of withdrawal is not valid for the following products:
- Products custom-made or adapted for personal use
- Products not suitable for return for hygiene and health reasons
- Products with opened or used packaging
- For returns made under the right of withdrawal, the shipping fee is covered by the SELLER.
ARTICLE 5 – PAYMENT AND REFUND CONDITIONS
- The BUYER can complete their order payment using credit card, debit card, or wire transfer/EFT.
- In case the right of withdrawal is exercised, the product price will be refunded to the BUYER within 10 business days at the latest after the product reaches the SELLER.
- The refund will be made using the same payment method used by the BUYER.
- Bank refund processes may vary, and the SELLER is not responsible for delays caused by banks.
ARTICLE 6 – LIABILITY AND FORCE MAJEURE
- The SELLER is obliged to send the ordered products complete, undamaged, and in accordance with the specifications stated in the order.
- Due to force majeure (natural disasters, war, epidemics, transportation disruptions, etc.) if the product subject to the contract cannot be delivered on time, the SELLER is obliged to inform the BUYER of the situation.
- The BUYER may request the cancellation of the order, replacement with a similar product, or an extension of the delivery period.
ARTICLE 7 – RESOLUTION OF DISPUTES
- In disputes arising from this contract, within the monetary limits determined by the Ministry of Customs and Trade, the Consumer Arbitration Committees and Consumer Courts at the BUYER's place of residence are authorized.
ARTICLE 8 – EFFECTIVENESS
- The BUYER declares that they have read, understood, and accepted all the terms of this contract when placing an order through the www.noktaoptik.com website.
- This contract enters into force on the date it is approved electronically.
